Then it is H turn and even before he gets up there he asked the judge if he could say what our marriage was like, the judge tells him NO we are here to discuss the TRO and only that. He then starts in that every thing in the TRO is a lie, that he never came towards me when I was rocking the baby, that DS was sitting on the couch watching TV. He then proceeds to say that he never spanked DS he swated him a couple of times when he thought he was doing something dangerous, that I said he has erratic mood swings, he don't I am the one who has those. He then proceeds to say that while I can't bring up her medical history she is suppose to be on antidepresants and has been hospitalized a lot in the past for mood swings. He is going on and on like this not getting at all that the judge thinks he if full of SH*#! The judge then ask him if he ever rasied his fist towards me and he says no, then says a couple of times only becasue she was nagging and daring me to do it. His big thing through out all of this was that I was a nag so he had to react that way sometimes. I guess you could say that he pretty much lied the whole stinking time he was on the stand, adn everything he said he always made it come back to me like if I hadn't done this he would not have had to do that. The judge is sitting up there signing papers and handing them to his clerk while H is still talking.
The ruling was that the judge did find I was in immient danger and that the TRO stand as is, the judge then asked if there were any questions and H says yes I know I can't see her but what about visitation with my son, I would like to see him more, the judge looks to see what the TRO said and he replies that the time he gets is standard time for a child DS age, and if he wants to dispute it then he has to file for divorce and have it changed there.
I was so nervous when I was up there but at least I gotsome pointers from my worker about the judge, (she use to work at the court house so she knows all of the judges), the one I had is big on respect so she said to look directly at him, when I answer say yes your honor or yes sir stuff like that I did that and I guess it worked, and also he is big on not doing any type of abuse in front of a child. It was a little nerve wracking but I just imagined that you were all there cheering me on so it was not so bad. Good thing is he can not contest teh TRO again evenif he gets a lawyer. So now maybe I can get on with my life. My worker said that what H did was typical DV talk and she can't believe how many of them get up there and lie about everything, or try to blame the other person for all of the abuse. Will I really should get to studying as finals are in two weeks, but I just had to let everyone know as I did not have access to a computer until today. Thanks for everything. Take Care!
