Hi Everybody,

Do divorce courts award money for pain and suffering anymore? My husband emotionally abused me. Or do they just award maintenance? We were married for three years and have no children. I'm trying to figure out how to file for pain & suffering. Any ideas? I'm in Colorado & don't see anything on the judicial website. I'm trying to do my own divorce, because STBX won't help pay the legal fees. Thank you, Melissa

I have never heard of that. States each have their own rules about spousal maintentance, and it is usually awarded when one parent has given up his/her career to stay home with the children, and needs time to be able to re-enter the workforce.

I am in Colorado also, and I have never heard of this. My guess is no. Because Colorado is a no fault state, the courts don't really care if he was abusive. Well, that was the impression I got from my atty. Good luck!

HI!!! Unfortunatey, the courts will not listen to the "abuse" status of our relationships during the divorce proceedings. But there is a marital tort law here in Colorado. If you can prove that your marriage was full of "outrageous conduct" on his part than you may be awarded punitive and monetary damages. It's a separate lawsuit altogether and will be quite extensive.

I am filing for marital tort as my husband was not just emotionally abusive but abusive in all other aspects too. It has to be done within a 2 year time limit from the last episode of his outrageous conduct. I still have 1.5 years left to get my lawsuit going. He doesn't think I know about alot of things but I do and he won't know what hit him by the time I am done!!! Men/women should never treat their spouses with disdain and contempt. Or any other person for that matter!!!!

Look up the marital tort law and read some of the cases on file. You will find out what the law considers outrageous conduct within a marriage.
