Hi everyone. I am a member of the relationships message boards, and my friend and I have ran across a few questions.

My friend, left her abusive husband 1 year ago with the kids. She has been struggling to get by, and now he has been suspended indeffinatly from work, for having a terrible attitude for the last year. She was recv'ing nearly 500 dollars amonth from him in child support. and now, no job for him means no child support for the girls. So we are dealing with her finding another source of income other then the current job, which won't bring enough money. But we were also wondering if He isn't able to pay child support, is she still required to let him see the girls? I know by judge order is, but is failure to pay child support enough to take away visits?

No, she would be in contempt of court if she did that. Child support and visitation are completely separate, you don't get to see your children more just because you pay, or less when you don't pay.

firstamendment is correct... support and visitation are two, separate, unrelated things and withholding visitation will look very negatively on your friend in the eyes of the court.

IN MANY, IF NOT ALL, STATES, THE CS COMES OFF THE TOP OF ANY UNEMPLOYMENT THAT HE RECIEVES. NOTIFY THE CS DIVISION SO THAT THEY ARE AWARE OF THIS CHANGE AND WILL GO FOR HIS UNEMPLOYMENT. THIS ONLY WORKS WHEN CS IS TAKEN BY GARNISHMENT.

your friend should also contact the family court and see about health care, etc for the kids. one of my friends was able to get (basically) free health care through a special state program for her boy while she was getting divorced.Also many guys turn to under the table work to avoid child support, but going to a judge to renogotiate the arrangements may be a good idea anyway
