I was a regular here several months ago when my divorce was new. I have a question now and didn't know if anyone here knew the answer.

Aside from the obvious answer of calling my lawyer (that would be too easy), does anyone know how I go about getting my son adopted by my new husband? XH has said in the past that he woud give up the boy heck he doesn't ever even see him now. Would we have to go to court or is it just some papers to sign?

It would probably depend on state law, but my guess is that you could both sign papers and have your attorney file them. The best thing is call the attorney and find out how the process works where you live.

you may want to think about it also in terms of how will your child feel when he grows up. my SO was adopted by his stepdad, who he has no closeness to, and since he was adopted (and his biological dad had to sign away any rights for this to happen) and his name changed he doesnt really have any kind connection to even his name. and his biological dad also had no visitation rights. yours may be a completely different situation, and hopefully it is a more positive one in your case.
but anyway, in this state
it USED to be
the bio dad had to agree to sign away any rights, and all parties had to appear before the court.
