Does it make a difference in court proceedings if you leave the house? In other words, if one spouse leaves does that hurt their chances to be awarded the home in divorce proceedings? We live in California with no children. The marriage was 9 years.

I found an article on divorceinfo.com that may be helpful. In a nutshell, it says "abandonment and desertion are vastly overrated as issues in divorce." I know the title of the article isn't very pleasant, but I think it relates as closely to your situation as I could find.
