Anyone dealing with retirement issues/mi

I think my H (STBX for way too long) does not think he has to share his retirement. We spent a lifetime together. He just retired from the military. My emotional state has kept me from finalizing the Divorce. I can not say for sure what has kept my H from doing it.
We had a conversation the other day and I think I heard hostility. I know he thought he should not have to pay alimony. How sick is he to think that he does not have to share retirement. I thought it would be by law(20/20 spouse) I almost can't believe that he would want to be that unfair. Is he struggling with himself or the OW? depression more because of retirement?

I'm on the other end. My stbx never stayed in any job long enough to have a pension or saved for retirement becuase he's always known he'd inherit enough to retire on from his parents. His inheritance is not considered in the divorce but my pension is. That sucks but it's the law. He gets half.

You'd think that after 28 years of marriage they'd consider that his retirement plan has always been his inheritance but they don't. I'll just consider the half of my retirement I have to give him payment for getting rid of him and move on.

You'll end up getting half. You're entitled to it. Retirement plans are a community asset.

Hi Julie,

Not sure what state you are in, but if you have been married for a long time you will get half of his retirement. In fact, they are changing the rules on the retirement now. It used to be if you were married 10 years or longer, but soon it will be calculated by how many years you were married. It's amazing, you spend years with someone and when they decide to look for greener pastures, they become these greedy little monsters and want it all. You deserve whatever you can get. Just make sure you get a lawyer that is interested in your welfare, not just your money.
