I am going through a divorce right now with my husband of two years. We have a two year old son. I recently took a new position back home where my family is located and my husband has decided he does not want to move and would rather get a divorce. We have our temporary placement hearing on Friday, Jan. 25th.. which is my birthday. Any one out there have any advice... supporting thoughts.. I am struggling with this and just looking for folks that understand what I am going through.

Thanks for listening/reading... Sirena3245

If you haven't discussed this with an attorney, you should do so ASAP. Unfortunately, if "home" is more than an hour or so away from where you are now and if your STBX has been a good father per the court, the court will be likely to give your STBX temp. placement. You may have to choose between that job and custody, as difficult as that reality is.

hi, yeah looks like when things go south it all piles on a person.. The birthday thing is typical.. A real downer... if you weren't already down to start with. Its hard and remmeber you are doing the right thing. Simply to stop all the fights, etc.. Thats what I am looking at too. Been married 6 years,, I have felt trapped since day one.. tried conseling therapy, all the above. This is just not for me.. Don't try to figure out who's wrong.. just feel confident you tried and it didn't work out.. Get clean.. and keep your eye open the right fellow may be sneaking up behind you..

Sirena,

Hi. Welcome to SD&S.

The only person who can give you legal advice is an attorney whose familiar with the laws of your state. Custody and visitation are determined by any number of factors, residential address being only one of them.

Do you have an attorney? If so, use your time with that person wisely and ask your legal questions. If not, many attorneys will work with you for an hourly fee. Hire someone who has dealt with divorce regularly and particulary with children in the mix. You may also have a paralegal service in your city that can answer basic questions about your state's divorce laws. Check the yellow pages of your phone book.

Good luck with your situation.

Thanks for the advice. I do have an attorney who has been working with me during this process. Hopefully Friday will be for the best. This is so very hard....
