moving kids out of state?

Hello. I am new. I am going to get a divorce & want to move my 2 kids out of state,ASAP. Does anyone know any custody laws or info?

You typically have to get it up front (in the original decree) or you'll probably have to go back into court to get it. At least that's the way I understand it. The attorney actually eluded to me that maybe I should move first, then file in the new state...something to think about....though states typically have a residency requirement. For example, you might have to live there 6 months before you can file for D in that state...
Mimi,
Only a qualified divorce attorney can properly advise you about your rights. I strongly encourage you to seek this advice before moving. Every state is different. In some states you can not locate to another state with your children. In others you may be restricted to a certain distance away from the other parent.
Again, only a divorce attorney can tell you what is appropriate in your state. Beware: if you up and leave with your kids without this advice or agreement with your STBX you may be accused of kidnapping.
Good luck.
