See this is what I thought but I don't want him to be bitter towards me if the court makes him pay some sort of support.

I don't reccomend you go for the him paying day care, for the very reason that MusicLover brought up. What happens why they are too old for day care? I reccomend you go check out an online child support calculator with the conditions you're described and get an idea of what he should pay in child support. See I went online and it listed about 640 if you don't count overtime (that he claims he can't work once he has the girls 50% of the time *insert rolling eyes* or 768 if he does.

Well even withouth his overtime, that's more than the daycare costs right? So I'd say don't agree to anything under that amount.

Something to keep in mind, most courts believe that the support for a child is owed to the CHILD and not to the parent. So if you're worried about "making him pay more" and that making him be angry, stop worrying. He isn't paying what you need - he's paying what the CHILDREN need, and it's not to you, it's FOR THEM. Most courts will not allow a parent to forgo the right for adequate support even if the two spouses agree on it, because it isn't the parent's support - it's the child's.

Don't feel worried about making him pay the amount he's supposed to. It's for the children's benefit.

See this is what I had thought but now after meeting with his atty this am, he is saying that if I can't afford to keep the girls then he wants them full time and I can not pay anything and can see them a few weeks in the summer and holidays and he will move back home :(


It is just so stressfull, I have never cried so much or been so stressed in my whole life :(

I think his lawyer is trying to scare you, and I would not be intimidated by him.
