Do you have your own lawyer? If not, I would suggest at least getting a consultation to find out these answers. It shouldn't cost that much money, but I think that if you have a house, retirement, maybe other assets & kids, it's crazy not to get a lawyer. Of course, I am biased, cause I am a divorce lawyer, but I see people who tried to go the do-it-yourself route, got a bad deal and then try to fix it later, when it's too late. I could tell you the answers for MA, but every state is different. You could also check w/ your local family court and see if they have any pamphlets to explain the process.
