The JERK did tell the police that I had hit him. He said that I was going at a high rate of speed and that I honked my horn at him....and NEVER slowed down...slamming into his vehicle!!! OK...that might have happened....in his dreams!!!

I was driving a laoner car form my dealership...with my 2 children in the back....

...and I would be driving pell/mell down the raod never slowing down..to slam into him...HMMMMM....I think not....plus, I would have had far more damage to my car!!!

THIS IS WHERE THE GREAT NEWS COMES IN:

I have an impartial witness~~~~

A woman who lives directly across from the accident has agreed to go to the police station to fill out a report.

She didn't see the accident...However, she saw where the cars were located....stopped in front of her house!

NOWHERE near the speed bump that he stated he was stopped at!!!!!!!

Which is what I had told the police!!!!!!!

I am soooooooo relieved to think that this CRETIN is not going to get away with this!!!!!

I am still in a goodly amt. of pain; but hearing this news has made me feel so much better emtionally...Especially since we both had the same insurance company, and they had stated that it would probably be a 50/50 fault finding....

Not any more...100% HIM!!!! YIPEEEEE!!!!

Thank you all for your kind concern, miracles do come true.....

I just wonder who's looking at the damaged vehicles? Surely they can TELL if they investigate accidents for a living who was stopped and who was moving. If they say they cannot tell, I would switch insurance providers. I know that even a police officer who has seen enough crashes could make that determination. Don't let them pin ONE DIME on you with a 50/50 split! If they try, contact a lawyer. Even with the witness backing up where you two were, they can try to make you pay.

Also with the van, fight with them over the cost, don't just pay it. If they told you one price when you took it to them, and then when they fixed it it still wouldn't work, WHY SHOULD YOU HAVE TO PAY MORE FOR THEIR BAD FIX? Also make sure you tell your insurance company about the place, especially if they recommended that place to you for fixing your van.

Lastly, get yourself to the doctor! You are in pain and you should be looked at. There may be a pinched nerve or a slipped disk in your neck that needs attention. If you leave it, you could do more damage. Go in and get checked out, please!

Jennifer, I'm so glad that you're feeling happier about things and that you have this good witness!
