NES for sears is harrassing me! help!

any advice is welcomed.here it is in a nut shell
i made a debt with sears which was small to start with on the credit card. my husband was out of work 2 years due to illness and not enough money to pay bills so it was food for my kids or sears, which do you think i picked. food of course. now the bill as accumulated to 948.00 . started out 500.00 a long time ago. i have been turned over to a company called NES and they called and told my son to call it was a legal matter. the account is in my husbands name and so i called back the next day and they said they would cut me a deal if i send them 800.00. they wanted me to post date a check for 800.00 and i told them i don;t have 800.00. they are continuing to call and tell me i need to pay the 800.00 now or there client will file suit against my husband. i made them the mistake of leaving my work number and they are calling work and home constantly . 5-6 times a day at home or more. i left a messge the other night for them that i was trying to get the money and i would not know anything until friday because thursday was veterans day and the lending institutions are closed. they called several times again yesterday. the night i left the message that i did not have the 800.00 right now and i just did not know what eles to tell them i just did not have it. the lady called back and left a message that if i did not pay the 800.00 by thursday i better borrow 1000.00 to 1200.00 becasue that is what it will cost me. i only owe 948.00 right now. why is she telling me i have to pay more? i have no money and i do not know what to do. any advice

if i send them a money order for 200.00 or 300.00 do you think this will get them off my back. the only thing i can do is go to a check exchange here and borrow the money and pay it back in payments. plus this account is in my husbands name should they even be discussing this with me by law.

They can discuss it with a spouse but not a child. I think they only do this if the spouse says they wish to discuss it. If you tell them they have to talk to your husband, I think they have to talk to just your husband.
Tell them they must not call you at work or you will file a compliant.
Search on the internet for a 'cease and desist' letter. This is a letter that says you will only work with the original creditor. Send it certified mail.
Also send them a letter that they may not contact you by phone, only by mail and make sure they have your home address. Send this letter by certified mail as well.
Do not borrow money to repay this debt. See if you can come up a plan to pay the debt off, and then when the debt has been returned to the original creditor make an offer to repay it over time.
They are saying you will have to pay more than the $948 because if the sue and get a judgement, there will be attorney's fees and court costs added to the debt. This can happen, but they are also using it to try to scare you. Do the things above and try to make arrangements to pay with Sears directly once the account has been returned to them.

I'm not a credit advisor so this is just my two cents based on my experience -
Have you tried negotiating to a dollar amount you can afford to pay? Maybe they would be willing to settle for two or three hundred...
Many times a creditor is willing to go down just to get something. My Sears acct went to collections and in my "stop calling me" letter that I sent to them I offered to pay less then half of what they wanted and they took it! You never know unless you ask, the worst thing I can think of is that they can say "no". It would at least open up negotiations for settlement. Most collector’s don’t want to deal with court costs and are willing to settle.
