last year the company i worked for merged with anothercompany and cut my department in half. therefore our workload doubled. then they said no overtime9 OR RATHER THEY WONT PAY OVERTIME) unless its at the end of the month when we are required to stay late (11pm many nights) to close the end of the month. The company was closed on christmas eve so the 5 of us had to work late monday, tues , wed and thurs night. I put in for my overtime but was only paid straight time because they said i had to physcially work over the 40 hours and being the company closed for christmas eve ( and they took away one of our personal days when they scheduled this) we would only be paid straight time. I dont think this is fair , if I took a personal day of my choice or called in sick i could understand it but not when the company decieded to close. I would have rather been home with my son those nights!
so i am missing that extra money i was counting on.

I know it's a bummer when this happens. It is customary practice that unless you physically work over 40 hrs, Overtime is not required to be paid. For example when there is a holiday and you work say 38 hrs and 8 hrs of holiday pay companies don't have to pay over time because you didn't physically "work" 40 hours. You would get paid 46 hrs of your regular pay. I am glad you had an opportunity to use a personal day for Christmas eve. I have worked at companies where they chose to close but the employees didn't have an option to use personal time or not. We were just short on our paychecks.

There are lots of loopholes that employers use to get out of paying overtime. President Bush just made more loopholes and exclusions for employers, too. Unfortunately he is on their side, not the middle-class working, struggling person's side.

Having worked for a super cheap employer that was trying to cheat its underpaid employees out of money, I'd have to recommend that you look for another job. It's probably only going to get worse there.

I didnt have any option, i would have worked christmas eve if they were open. The company chose to close not me so i should be penalized that they wanted to close for their holiday
Also i didnt want to work those nights, but was told i had to.
