About Screaming Bill Collector
| Wed, 06-08-2005 - 7:31pm |
Hello everyone, I would like to know if there is somewhere that I can report a very rude and screaming, threatening bill collector, I am being harrassed by this company that is collecting a cell phone bill. They refuse to take any form of payment except payment by phone or check over the phone or cc which I do not have.
I refuse to let anyone have excess to my checking account. I have gotten into trouble doing this sort of thing and I refuse to do it again.
I have told them that I will send MO and they just ignored me. I tell them that I am not refusing to pay the bill, just refusing to pay it the way they request.
Thank You for the help , Carolyn

Hello and I'm sorry that you are going thru this. I've been in your shoes a couple of times or three. I will keep this brief as I know the other posters will guide you in the right direction. I suggest you mail in your payment (whatever amount it may be-trust me they will not turn it down). Before you mail the payment (by money order), please make sure to document all what has been going on. Nothing works better than it being on paper. Furthermore, you can request in writing that they do not call you, especially at work. Although, we are in collections, we have rights also, especially if you are honestly try to pay. Believe it or not, I found this out thru this board and also doing some personal research. Once I was armed with this knowledge, things changed big-time for me. I beg of you to please document everything, we are all human and make mistakes. I just want to add, you are in a most supportive place and will learn a great deal, as I have. So please stick around. Take care of yourself and God Bless.
P.S.- I know it's hard, but please try not to stress over this, like I said earlier, I've walked in your shoes before. The success stories were my main inspiration, please keep this is mind. I have a lot more I would like to say. See and this was suppose to be brief (smile)!
Do mean names and times and days when you say document.
I am trying to become organized so I can make timely payments, Again Thanks and I will stay around and learn. Carolyn
You should che3ck out the Fair Debt Collection Act website at: http://www.ftc.gov/bcp/conline/pubs/credit/fdc.htm
I think that will help you out a lot. I know a few people on this board have said even just mentioning the Fair Debt Collection Act makes collectors behave better. Once you know your rights, you can document will have a better idea of what to document.
Here are jsut a few points from the site:
For example, debt collectors may not:
use threats of violence or harm;
publish a list of consumers who refuse to pay their debts (except to a credit bureau);
use obscene or profane language; or
repeatedly use the telephone to annoy someone.
Debt collectors also may not state that:
you will be arrested if you do not pay your debt;
they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
Debt collectors may not:
give false credit information about you to anyone, including a credit bureau;
send you anything that looks like an official document from a court or government agency when it is not; or
use a false name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:
collect any amount greater than your debt, unless your state law permits such a charge;
deposit a post-dated check prematurely;
use deception to make you accept collect calls or pay for telegrams;
take or threaten to take your property unless this can be done legally; or
contact you by postcard.
I was actually going to post information on the Federal Fair Debt Collections Practices Act for you, but usg1865 has already done it so well that there is no need to repeat it.
