I've posted on here several times about all of the bills that my husband has and how 100% of them are way over a year old.

You can not serve someone else. They must serve your husband hand to hand or you can get served by signing for mail. I know that much. It is a bad serve if he wants to fight it. What I think the magistrate is talking about is what they call an agreed judgment. Where you agree on so much a month so there is no attachment or garnish of wages. Only thing is if one payment is late or missed the agreed judgement goes out the door.


Count up the bills you owe that is how many people that can sue you if they want.


By the fact it is a bad serve you husband could just go and agree on a price and the hearing most likely will never happen and it might just end up on your credit as a bad debt and not a judgement.

So once he goes and signs the papers today it is considered a judgement at that point?

First of all, was this credit card included in the original bankruptcy proceedings?

None of his credit cards was included in my bankruptcy - I filed single bk - we didn't file joint - the credit cards are just in his name.

Okay, I was confused with your first post when you said that he was able to file BK when you did, so it sounded like he had filed BK also.

Sorry about that - I made a mistake in that post and should have said he was not able to file bk.
