I am a partner in an LLC (limited liability company), and I am amazed at the tax rules. I would NEVER try to do this without the advice of someone who completely knows the tax rules for the kind of small business we are. Ditto for the attorney.
A key element of being in business for yourself is minimizing risk - don't skimp on hiring professionals who can minimize the risks that aren't related to actually doing business. Your husband will be taking enough risk in that regard!

I think you definitely need to talk to an accountant if you are thinking of having him issue you a 1099.
