Hi, I'm new here and in a downward spiral I can't climb out of. I've been out of work for 6 months and unemployment isn't cutting it. I can barely pay my rent, car, insurance etc...as if that's not bad enough today I received a summons from a lawyer for a

Thank you so much for your response! I know I am responsible for the debt, I have every intention of paying it as soon as possible...I will take your advice and call the plaintiffs attourney and explain and see if we can work out something.

Thanks again...I took your advice and just got off the phone with the atty (actually, it was just a debt collector) and he was willing to work out a payment plan so that I could disregard the summons. It's going to be really hard, but at least I don't have that hanging over my head. so again I thank you for your sound advice.

I'm glad you were able to avoid court and work out a payment plan.


You will need to find ways to increase income and/or slash spending.

I have questions First did a sheriff or a summons server hand you the summons in person? Did you get it in the mail and have to sign for it? Either way it is a summons that came from the court. A letter in the mail that is not signed for is not a real summons. But I still would not trash it in any case.


If either of these things are what happened then some guy on the phone telling you to disregard the summons is telling you wrong.


Dig the thing out of the trash and you see what date is on it and what court you need to show up at. And you show up and you tell the judge that you are out of work and that you would like to work out something with the lender or credit card but all you have is unemployment coming in and have a list of your bills to give to the judge Like your rent and electric and such. Just the household bills is all you need
