Ok thats what I thought you did.A better seat for her since she is only 3 would be the Graco Nautalis.It goes to 65 lbs with a 5 pt harness.Then it becomes a high back then a no back booster seat that goes to 100 lbs.The high back part and harness are good for 6 years and the no back part is good for 8 years. The absolute minimum for a booster is 4 years old.Most techs like to see kids in a 5 pt harness till 5-6 years old.Part of the reason is for maturity and the other is there bones are still calcifying. So at 3 a booster seat can actually cause harm as there little bodies are not able to handle the forces a crash puts on them.
eddited to say there are other seats that go over 40 lbs with a 5 pt harness. If you are interested I can tell you more about them.
I thought the same thing when I read the original post (about a 3 yo in a booster) but didn't want to make any waves. My 5 yo son has the Nautilus and we love it. Just today he fell asleep on the way home from my in-laws and his head fell forward. If he were in a booster seat with seat belt he wouldn't have stayed upright and wouldn't have been well-protected if we were in an accident.
Then again my 2 yo still rides rear facing so I'm a bit anal about this stuff. :-)
I am glad that Jenn's daughter wasn't in the car when the accident happened and that her insurance company paid for a new seat.
The one we are replacing was a Cosco Alpha Omega Elite.
