As we speak my gf is at her lawyers filing her divorce papers.
I'm sending a venomous wish that if your gf's ex does try to walk away with the 401k, that his lawyer's hands develop a rash everytime he or she picks up the phone, or picks up a pen to take away something that hers.
Other than that you have my prayers and positive thoughts.

I really hate to be the one tell you this but I just went through this ordeal not to long ago. They will take the amount of the 401K before the date they were married and the total of it the day they separated. When they find out what the total is that has been made that is the amount that they will have to fight about. I had started my 401K a month before we separated. So the amount of mine was very little. But his amount was higher. We were only married for two years and his amount was about 5,000.00 (maybe a little more) in that two years. So my lawyer said that he had to give me at least 2,500.00 of that. I wasn't really looking for anything just the divorce to be over and done with. He offered me 1,500.00 from his 401K and I toke it and ran! So yes she will have a chance before the divorce is taken to court to setle on a amount.
There's no way (unless everything was in totally her name) he will wak away debt free. My exH had owned his house before we were married so that debt was aganist me. All other bills he had before the marriage too - not held aganist me either. There were no debt's made while we were married so that worked out in my favor.

There are so many factors involved, but if they can't work it out and have to go to court, the judge isn't going to let him walk away without any debt responsibility. There are certain "givens" in these situation, even though most things are negotiable.
