Are they currently on an IEP/IFSP Plan? If so, the district is already out of compliance. They can not remove a child from their IEP/IFSP without an eval!
If they are not currently on an IEP/IFSP, it would probably be a good idea to have them reevaled at this point. It is ALWAYS better to catch any problems early!! Many school districts want to wait until the child is in third grade. By then, the child will be in Resource Room and possible more until they graduate according to studies done on the subject.
To start with, make any and all requests in writing sent via registered mail with verification of receipt. THis is your proof that they did receive the letter and when. If you are already saying to me that you have to fight for an eval, you need to do this. Here is a letter template to use in writing to ask for a reeval:

Please evaluate (child’s name) under the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act within 60 (sixty) calendar days to see if s/he has a disability and if related services or assistive technongly are necessary. Please consider this letter my consent to evaluate (child’s name) for special education needs and services. I would appreciate it if you would schedule the evaluations as quickly as possible. Please call me at home to arrange times and places. I will need my copies of all written evaluations at least five school days before the IEP Team meeting. I will advise you of my IEP Team meeting availability dates by separate letter.
Thank you for your help. I look forward to hearing from you soon.

The school will probably not like you giving them timelines. The IDEA, the special ed law, just underwent some major changes. One of those changes is that the district only has 60 CALENDAR days to complete testing and hold a meeting to discuss the findings. In the past, the IDEA allowed them to take up to 90 school days to complete an eval. What a difference, eh??

It's interesting what different studies show. The studies I have seen that talk about pre-k vs. no pre-k and all day k vs. part day k vs no k show that the children who have less of either of these eventually catch up, usually by middle school. It also, IMO, depends on whether the parents are giving the children any kind of enrichment.
In speaking of what is expected of our children now vs. in the past, I would disagree in part with the other poster. I think that our children have less expected of them in each subject, but they have more subjects to cover. I think that's where everyone's frustration comes from.
I would love to see our kids going back to basics. Have band, choir, home-ec, shop, but have it in a lesser degree and the basics in a greater degree. My dh is Canadian. I look at what the expectations are of children there vs. here. Our kids have about 60% of the expectations as do their kids! This goes for many other industrialized nations as well. They have longer school days and longer school years.
Anyway, not to start a debate or cause a problem! I hope this isn't taken that way. It isn't meant that way.
