I got the report from the adjustor that the other guys insurance company sent out. His estimate was about $160 less than what the auto repair shop estimated. He is recommending that the tailgate and bumper be replaced with parts that are not from Ford, but rather from some foreigh place. At the same time he estimated more labor than the auto shop did, so that even though the difference in the cost of the parts is about $300 or $400, the difference in the total estimate is only $160.

Why do I have to settle for substandard parts? Their insured was fully at fault and admitted that to the police officer. I feel that they should pay for fixing my truck to what it was before the accident. The whole thing wasn't my fault. The only part I had in it was being at the wrong place at the wrong time. They should be darn happy that I wasn't hurt in it. After all, I was hit by a gravel truck with a full load of sand.

Does anybody know anything about insurence or auto repairs? Do I have any recourse? Should I contact my insurance company and see if they'll fight it for me?

Kaci, you can always threaten to sue them for the full damages. Just threatening them may cause them to settle for the amount you want. If you have Collision insurance you can also just go through your insurance company, although you may have to pay the deductible right now. When your company goes after his company, they'll get the deductible back for you. What I would do is tell their adjuster that you're getting a lawyer to handle this whole mess because you think you're starting to get ...... headaches or a sore neck or something like that. I'm willing to bet they settle PRONTO!

HI Kaci I don't know a lot about insurance companies and if complaining to them would help you much. I do know when I got rear ended about 5 years ago I had to put up with those type of parts being put on my car. I didn't want them and tried to get my insurance company to let me have the parts made by the orginal maker of the car but they said the cheaper parts were just as good.

I would at least talk to my insurance company. I'd think that for $160 difference that they should give you Ford parts. Just call your agent or insurance company and then make your decision. I vote for getting it back the way it was or my neck would really start to ache probably with whiplash. Hugs, BB

Oh Boy Kaci! I think if it were me I would get ahold of my insurance CO and see what they say.

I don't think they should be allowed to go so cheap on the repairs maybe just hoping that you won't speak up

One thing that I have learned (although I'm not very good at it) and that's that the squeaky wheel gets the grease. You're not going to come out ahead by being really nice about it all. I think you should write a letter to them and spell out the fact that you were not at fault and that you want your vehicle back the way it was, not a morphed version of this car and that. And I think a copy should go to your insurance company, his insurance company and the trucking company. $160 can't make all that much difference to them and I think that if you fight for it, you'll get it done right.

My suggestion would seek a laywer. It would not hurt to see what your apptions are.

You don't have to settle for substandard parts. Insurance companies try that all the time. Saves them a ton of money of course.

I'm pretty sure in this case you can just say..no, not acceptable. If you have an insurance commission in your state, which most states do, I'd check with them.
