John Kerry has said that Saddam had weapons programs and needed to be disarmed (although he wanted to do it the sane way, through inspections and as a last resort, multilateral military action.) Hans Blix and David Kay have both said that although they believe there are likely no large amounts of WMD, they wouldn't be surprised if a few old caches turned up here and there. So your statement that "up until now THEY were saying there were no WMD" is an oversimplified statement, especially if you're pointing to just one artillery round.
A good point. What the article should have said was "If confirmed in subsequent testing, the discovery would be teh first evidence of a banned WMD in Iraq since the war began. The Bush administration based its case for the war on the existence of stockpiles of WMD."
I'm sure you'll correct me if I'm wrong, but the only banned "weapons" (not program, equipment or substance) in the Kay report were those missles that went a bit further than they were supposed to. We certainly didn't go to war over those.

There is another option: the sell was recently filled. The last I heard any information they were sending the shell for examination. The quest was to find out whether a membrane separated the two ingredients. It was believed that Saddam didn't have this technology.
