U.S. seeks do-not-call civil penalties

WASHINGTON -- The government is seeking penalties against a Nevada-based telemarketing group for alleged violations of the federal do-not-call registry, making calls to more than 300,000 people whose numbers were on the list.
The civil penalties against Braglia Marketing Group in Las Vegas and its principals, Frank and Kate Braglia, would be the first for violations of the registry, the Federal Trade Commission said Tuesday.
The commission said the telemarketing firm called people on behalf of its clients, including Flagship Resort Development Corp. and Atlantic Palace Development, which sell timeshare resort properties in Atlantic City, N.J.
The firm made calls to hundreds of thousands of registered phone numbers since Oct. 17, 2003, and has made more than 10,000 calls to various phone numbers without first paying the required annual fee to access the registered numbers in those area codes, the agency said.
The government also said the firm abandoned calls to consumers by failing to connect the call to a representative quickly after people answered the phone.
The firm could not be reached immediately for comment.
The commission voted 5-0 to refer the matter to the Justice Department, which filed the complaint Monday at the commission's request in the U.S. District Court for Nevada.
More than 63 million numbers are on the list, the FTC said. People can register numbers or file complaints at www.donotcall.gov or by calling 1-888-382-1222. Firms that call numbers on the list face fines of up to $11,000 for each violation.
