"Supporters on both sides have deluged the California Supreme Court with dozens of briefs. The court has agreed to hear the case on March 5, extremely quickly by judicial standards, and it has three months after oral arguments to rule."

This doesn't surprise me. I'll go out on a limb & bet the ban will be overturned.

>"State Attorney General Jerry Brown, the former governor, wants the court to reject the ban, arguing it curtails the right to liberty that is paramount in the state constitution."<

If the court is superior to it's own Constitution, then we must drop any pretense of rule of law. We shall be condemned to a tyranny of the judiciary.

The Constitution is the basis of authority for our courts. If courts start to declare parts of our Constitution unconstitutional we are set up for a tyranny of the courts.

California can undo its amended Constitution with another election. If the courts do the work of the people, then the people don't matter. We lose control of our Constitution and our government.

And if the original amendment was unconstitutional in the first place?

I think that all this going back and forth with the Gay marriage issue is a waste of time. Two consenting adults should be able to marry. It doesn't matter if they are gay, straight, black, red, whatever. They pay taxes just like any other American. Relationships should be a personal matter. Just like religion is. The government should not interfere.

If a bill is introduced on the ballot, the people vote on it.

I hope so, too! Voters should not be able to eliminate civil rights of other citizens.
