Abortion foes' 3-part bill may have the votes

PHOENIX — Hoping a new governor means a different result, abortion foes have combined three separate — and previously vetoed — abortion measures into a single bill.

 

HB 2564 would:

 

• Require women to wait for 24 hours before terminating a pregnancy.

• Allow health professionals, hospitals and pharmacists to refuse to perform abortions or provide "morning after" pills or even to "facilitate" a woman getting access to either.

• Specify what factors a judge may consider in determining if a minor is mature enough to have an abortion without first getting parental consent.

 

Rep. Nancy Barto, R-Phoenix, said she believes life begins at conception, and if she had her way, abortion would not be legal. That also is the view of two of the major supporters of the measure: the Center for Arizona Policy and the Arizona Catholic Conference, which represents the state's Catholic bishops.

 

But Barto said abortions are legal and that the provisions in her measure are not a back-door way of undermining that right.

 

"These will not stop one abortion from occurring if a woman wanted to go ahead with it," she said. "These are just common-sense provisions that will protect the rights of women."

 

Barto may already have the votes she needs. All three of measures have previously been approved by the Republican-controlled Legislature, only to be vetoed by Democrat Janet Napolitano.

 

And 12 of the 30 senators as well as 27 of 60 representatives already have signed on HB 2564 as sponsors.

 

Barto said she has not yet talked with Gov. Jan Brewer about the measure. But the two-term legislator said she believes, based on Brewer's positions when she was a legislator in the 1990s, the new governor will sign the measure.

 

Brewer press aide Paul Senseman would not comment on the bill but he said Brewer "has a very strong, solid track record of being pro-life."

 

The broadest part of the measure provides what Barto said is "informed consent" by women who are considering an abortion.

 

That includes providing, face-to-face, details of the nature of the procedure and the immediate and long-term risks associated with the procedure. Patients must also be told the probable gestational age of the fetus — referred to in the legislation as "the unborn child" — and the "probable anatomical and physiological characteristics" of that unborn child at the time the abortion would be performed.

 

Other provisions require a woman to be told:

• Medical assistance may be available for prenatal care, childbirth and neonatal care.

• The father of the unborn child is required to provide child support, even if he offered to pay for the abortion.

• Public and private agencies and services are available to assist a woman if she chooses not to have an abortion, whether she chooses to keep the child or give it up for adoption.

As one who knows childless women who at a very young age were rushed into abortion and are now tormented by every bit of knowledge they gain on the procedure and the potential aftereffects I think it is only right that a woman and especially a teen receive full disclosure of all available information.

Oh, BARF! Not again! Reducing women to being brood mares and then telling them they have no procreative rights or self determination. Isn't that just hunky dory? Back to the Dark Ages. At least women could cross the border to California if this travesty passes...and be treated like an intelligent human being with full rights regarding her reproductive choices.

That is, women with the means to travel to California. I drove from Cali to Colo a few years back. There are some long, isolated stretches of highway one would have to travel to get to the services they need. Back to the Dark Ages is right, like when American Women crossed the borders into Mexico to get services pre Roe V. Wade. Makes me sick that we still don't have medical equality in our "evolved" country.

ITA! No medical equality yet for every woman in this country. Roulette by state. :(( Keep women subjugated by controlling their access to reproductive medical care and reproductive freedom of choice and self-determination. Amazing such backward legislation is seriously proposed much less in danger of being passed in *ANY* state in 2009. (Or FLASH! Is it 1309? Sometimes it's hard to tell, eh? Eye roll.) UGH!

Every time I see a bill demanding a 24 hr. waiting period, the only thing I can think is that the people who wrote it are either stupid, ignorant or just don't care if the facts support their opinion.

We can only be said to be alive in those moments when our hearts are conscious of our treasures.

ND House Passes Abortion Ban

North Dakota's House of Representatives has passed a bill effectively outlawing abortion.

The House voted 51-41 this afternoon to declare that a fertilized egg has all the rights of any person.

That means a fetus could not be legally aborted without the procedure being considered murder.

Minot Republican Dan Ruby has sponsored other bills banning abortion in previous legislative sessions - all of which failed.

He also sponsored today's bill and says it is compatable with Roe versus Wade - the Supreme Court decision which legalized abortion.

(Rep. Dan Ruby, -R- Minot) "This is the exact language that's required by Roe vs. Wade. It stipulated that before a challenge can be made, we have to identify when life begins, and that's what this does." VO CONTINUES But Minot Democrat Kari Conrad says the bill will land North Dakota in court, trying to defend the constitutionality of a law that goes against the Supreme Court decision that legalized abortion.

(Rep. Kari Conrad, -D- Minot) "People who presented this bill, were very clear that they intended to challenge Roe versus Wade. So they intend to put the state of North Dakota into court defending Roe vs. Wade"

The bill now goes to the North Dakota Senate.
