6 year old girl facing eviction

While it's not breaking news (it's been ongoing for 4 years now), this is a truly heartbreaking story. A 6 year old girl in Florida faces eviction from the home she shares with her grandparents, who are her legal guardians. The grandparents live in a retirement community, where the by-laws state the residents have to be 55 or older.
The grandparents were aware of the clause when they purchased their home, but that was before they took custody of their grandchild. They've since put the house on the market so they can afford to move, dropping the asking price from around $250,000 to $129,000, but with the housing market in the slumps, it still hasn't sold. Now a judge will have to decide if the child needs to be placed with foster parents.

I remember this case & am surprised it's not resolved. It would be criminal to put this child into a foster home when she has loving grandparents.

I'm wondering if they are allowed to rent the unit out.
I've been reading news reports and nothing mentions renting, though, but the AP mentioned today that their option is for one to stay in the condo unit and the other to move with the child to someplace else rented.

Personally I think anyone who moves to a HOA dwelling is making a huge mistake. But rules are rules, and the grandparents certainly were aware of them when they chose to live there. While they certainly couldn't have anticipated their dopey daughter's actions I find it odd that they have not complied with the policy they agreed to. It has been more than 4 years since they got custody, and I can't believe the real estate market has been that bad for four plus years.
