Sure I have. ELL's are given 12 months BEFORE they are tested by NCLB. It appears your opinion is different from that of those who run our federal department of education. How many years would you like to exclude non-English speakers from testing? 12?

I think that improvement, a bar which is raised every year, should be measured individually. I don't think it is reasonable to measure your child against my child for example. By the way, I have never taught a class that did not meet AYP, I just recognize that there are flaws in the legislation that need to be addressed. Also it was never fully funded and some of the administrative costs cut into funds that could otherwise be used for classroom supplies and materials.

I do not suggest attendance be optional - but since schools have no law enforcement privileges they have to rely on the state to enforce the legal consequences - that is not always enough and can be a long drawn out process during which the child or children are still not attending school and the school is still held accountable.

Additionally, students who are in transition are required to take the test.

My own state began testing in 1997. Okay, now what were the actions taken if a school continuously failed? Answer not a whole heck of a lot. NCLB actually began to say repeated failure has consequences.

It is important to replace the phrase in green with: a certain percentage of a subgroup of the children who attended the school performed poorly on the test.


To me there is a HUGE difference between a group of students unable to hit a relatively arbitrary benchmare, and a school being a failure.

If the custodian continuously fails to ensure school attendance they should no longer have custody of that child.
