The justices uphold the same-sex marriage ban but also rule that the 18,000 gay couples who wed before the November vote will stay married. The decision is sure to spark another ballot box fight.

Reporting from San Francisco -- The California Supreme Court today upheld Proposition 8's ban on same-sex marriage but also ruled that gay couples who wed before the election will continue to be married under state law.

The decision virtually ensures another fight at the ballot box over marriage rights for gays. Gay rights activists say they may ask voters to repeal the marriage ban as early as next year, and opponents have pledged to fight any such effort. Proposition 8 passed with 52% of the vote.

You appear to be working under the assumption that homosexuality is a choice and that homosexuals are choosing to love someone of the same gender as themselves rather than the opposite.

ding ding ding ding ding!!!! we have a winner!!! yes that is the point taken, we here all REALIZE that a clear thinking person wouldn't want to marry their sister, brother, cousin, etc, but pandora's box is open, marrying the same sex for CONSENTING adults is ok, why not for two siblings who are ALSO CONSENTING adults....why does one get to do it when another doesn't? i'm not for marrying my cousin, brother, etc...however, if we are all adults why does one get to marry another adult when it is not ok for everyone to marry whatever, whomever they want, do you see it?

it's not making sense because none of this is making sense....if you are going to open up marriage to marry the same sex, it shouldn't matter who that same sex is, do you see it? i'm not for it, but i see the argument for it. it is downright nasty for me to think of marrying a cousin, brother, sister, but if they are CONSENTING adults shouldn't they have that right to marry another "consenting" adult? i tell you it is pandora's box, there is so much that can go wrong with this.

ok then i'm a male who is in love with my cousin and we are both consenting adults, what is my right then? heck we didn't even know each other existed until we met when we were 24, and even then when we met we didn't realize we were related, we even got engaged, but now i'm told i can't marry him because we are related? what about us being gay? can't i marry him because he is a male and i am a male? *scenario waiting to get to the supreme court*
