Honestly, I think I'd agree with your husband. There's really not much you can do as a non-living-together family member, and any measures that would be remotely helpful to your niece would probably involve some kind of encroachment on your SIL's territory. Obviously you wouldn't want to go about it in some kind of underhanded way - sneaking your niece a loaf of whole wheat bread here, smuggling in a bag of veggies there. :)
The only non-invasive thing I can think of is to maybe give her a gift of some teen-oriented fitness and nutrition books, or a subscription to a relatively good fitness magazine like Oxygen, and hope she learns that way.
