we were so close to getting Rylee evaluated at a center here to recieve an official diagnoses, but now they are telling us since its less than 60 days to her 3rd bday they wont do it! shes the school districts responsibility now! grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr i cant believe i was so close, and now we are back to square one. im not getting anywhere with her psychologist and at this point wouldnt even want her to make the diagnoses.. grrr im so frustated!

OK, here is what you do. You call up the spec ed pre-school dept of your district. You may have to get the number from the spec ed dept itself, (check the county/district website). If you get no joy from the phone, you send a registered letter to them requesting that your dd be evaluated. In the letter list specific concerns you have. And I mean list them ALL, even things you are on the fence about; eg: speech, fine/gross motor, playskills, adaptive behaviour, feeding, sleeping etc.

If it's in the hands of the school system now they have to evaluate dd within 60 days and FAPE (Free and appropriate education)and IDEA (Individuals with disabilities Education Act) apply.

Can they do that? She is still Early Intervention's "RESPONSIBILITY" until she actually turns 3 - they can't deny services that can be provided before her third birthday, can they?

My dd was in early intervention until January 4 of this past year (when she turned 3) - three months before that, we talked about having her tested with the ADOS and they had some conversation back and forth with the school system about who should test her and when, etc. and they decided that they would put her on the waiting list (there's a long one here in NC for the ADOS) for both agencies (the EI and the school system) and whoever came up first with a spot for her (if it was before her third birthday) would be the one to administer the test.

Good luck and I'm sorry they're making this so difficult.

Yup, you know why????!!! She is 30 days from her 3rd birthday and the new IEP laws state they can take up to 60 days to complete and evaluation, hence their argument...the F'ers.

and yea im shocked no one told me about this dead line and clearly my primary coordiantor never knew either because she was just as shocked as me , when they denied seeing my daughter. i mean Rylee has been in early intervention since she was 19 months old , we just recently decided to go to this center because her personal psychologist wasnt comfortable giving the diagnoses, i would have never waited till the last min if i had known.. i feel like the system has failed us in a way. i should have been adviced, shouldnt i have ??

I totally agree with you. However, you are learning very early on the system and those that work for it often aren't always aware of what they should be doing. Know you are your dd's best and only advocate. By all means get others to facilitate, but you are the bee's knees (as me Da would say, lol). Fight, fight fight, you will prevail!!
