Kids removed due to race?

I think DHS in Oregon really messed up on this one, and if it's due to race then that's even worse.
A brother and sister (ages 10 and 12) had been living with their foster parents for over two years with nothing but positive reviews from case workers and the children's biological family. After the adoption process was well under way, the kids were suddenly taken away. The judge is even angered by the agency's actions, which still have never really been explained. Unfortunately, the judge cannot order DHS to return the children because it's not something granted by the state legislature.
The foster parents don't want to believe that their race (the foster parents are black while the children are white) has anything to do with this, but they're not being given any real explanation.
Can an agency in your state remove children due to race?
