Hello,

My husband has a court date in November to get 50/50 custody of his son. Of course child support will also be determined as well. My husband tells me that my income will not come into play. I have been told by others that it actually can. My husband makes less than his ex so we were thinking that she might possibly have to pay him. If they count my income as well then we will have to pay her. I am very upset at the fact that I might have to pay his ex for support of their child! It just doesn't seem right! Is anyone's husband's child support based on both of you incomes? Thanks

It all depends on what your State has in it's rules for these situations.  I'm in Canada and in no way is my income considered into the mix where my DH and his ex is concerned.  Is there someone you can call within the Government offices and ask?  I assume your DH has a lawyer, can you ask him/her in advance of heading into court?

I can understand how you are feeling about this...make sure to have all the facts before court to make sure you know your rights!!

My husband and I live in Indiana and he has to pay child support for 2 children. I used to work full time but my income was never taken into account. Research the laws in your state online or you could just call and ask an attorney. They should be able to tell you without a consult or payment. You could also call your local child support agency and ask them. Don't stress about it. Usually, if they share custody neither may have to pay support if the child(ren) spend equal time with both parents. It wouldn't make sense for them to pay eachother if they share time equally.
