This is true in Canada (although I am the exception). But you can not get a divorce until you have been legally separated for one year. So most people are quick to get that legal separation because it determines child support, visitation, etc. which you would not want to wait one year to get it into effect for most people. I know in the US there can be quickie divorces where within weeks you can be divorced, but many also drag out to 5 or more years. I think it is not cheating if you are separated with the intention of divorce. Now if one party thinks they are going to work things out then you shouldn't be dating, but if both have agreed the marriage is over and its just a matter of formalities then its not cheating in my opinion.

Like I said before, more than likely, this man was cheating during the marriage. Also, when i went through my divorce, there was not a separation agreement. My divorce was final from start to finish within 8 months. As soon as my ex moved out, I changed my bank account to a separate one, and protected myself financially with credit cards, etc. Nothing went wrong. Luckily, we agreed on everything...who got which house, etc.
As far as suing for adultery, I don't think that matters in a divorce. Ca. is a community property state, each spouse is entitled to half of what the couple owns...and it is a "no fault" divorce state...it's really a joke. What would suing for adultery do anyway? Get you more money? Not really. Child support is based on a calculation of the kids ages and how much money you make...it's not about who did what...it's call irreconsilabe(sp?) differences.
I think what Canada does is great, making couples wait a year to divorce.

There are some states where that rule is in effect too, I have a friend in Maryland who said she had to wait at least a year before she and xh could actually divorce.
