I wonder why they say the fetus was a MURDER VICTIM since it is not called murder ( when it is called a fetus) The debate call banned murder for fetuses. It is called Killing.

What do you think?

I think fetal homicide laws are stupid, but performing an abortion against the will of the mother is still illegal.

ETA: Fetal homicide laws have been pushed into legislation by PRO-LIFERS who are trying to establish legal grounds for fetal personhood. Not everyone agrees with the validity of these laws, obviously.

probably because she was 28weeks pregnant and pass the point at which abortion was legal. Is she had been 5weeks, 8 weeks, 12 or probably even 20 weeks they would not have charged him with murder

That's true. I've never heard of a murder conviction for a fetus that was only 8 weeks.

I believe that because the choice to be pregnant has been taken away from the woman, a crime has been committed. Would I call it fetal murder/homicide? Not sure, but the fact remains that the fetus' life was taken without consent of the mother and therefore a crime has been committed.

That's not true. You begin your 7th month at 28 weeks. If she was 6 1/2 months she would've been 25-27 weeks.

Not true.

http://caselaw.lp.findlaw.com/data2/californiastatecases/s112443.pdf

“Murder is the unlawful killing of a human being, or a fetus, with malice
aforethought.” (People v. Hansen (1994) 9 Cal.4th 300, 307 (Hansen); § 187,
subd. (a).) “iability is not an element of fetal homicide under section 187,
subdivision (a),” but the state must demonstrate “that the fetus has progressed
beyond the embryonic stage of seven to eight weeks.” (People v. Davis (1994) 7
Cal.4th 797, 814-815.)

Here's a conviction for the death of a fetus before viability.

It's getting to the point where with science and what we know of fetal development pro-choicers are having a harder and harder time debating whether it's murder or not. Now it seems their arguements all center around whether or not the woman has the choice to murder.
