How should we determine personhood?

There's another thread where there seems to be an irreconcilable difference between the two sides of the debate.

The big difference lies in whether a z/e/f is a fully invested person w/ all the rights of personhood.

In general, the PC side states that a fetus isn't a person w/ legal rights until it is born.

That's a tough question for me. Morally A fetus is a person as far as I am concerned which is why I only support abortion for fetal and maternal health reasons.

Legally though giving a fetus full rights as a person is a very grey area. Even leaving abortion out of it allowing full rights would open a can of worms that I don't know if we could deal with.

For example would having a glass of wine during pregnancy constitute giving alcohol to a minor?

On the upside a man who abuses his pregnant wife would also be charged with child abuse and possibly loose parental rights.

I think a fetus should have some rights but rights of a full person is too far.

OT, but funny - Seth was home from school on summer break and was using my car quite a lot. The other day, I opened up one of the storage compartments and found some condoms...I know darn well they aren't mine!

So I send him a text "why are there condoms in my car?".

No response. But only because he knows I can't stand the girl he's knocking boots with when he's home. LOL

True - thank God I taught him better than that.

Lesson 1 - if you're too embarrassed to buy these, you're too embarrassed to be having sex!

So you're saying electrical activity in the brain is the point at which there's personhood?

If a pregnant woman was to slip on your sidewalk and miscarry, would you be charged with manslaughter?

If a pregnant woman became ill, and she was carrying a non-viable fetus, and treating her could cause damage or death to the fetus (chemo, for instance) whose rights would prevail? How would the physician choose between the two, if they both had equal legal personhood status, and were considered separate patients?

<Electricity, electrodes in the brain. When they appear, there is function.>

Isn't that true of all living creatures? Unless I misunderstood, I don't think the issue is whether the fetus is alive. Clearly, it is. The question

Are you saying that this is the one definition of consciousness? And therefore life and personhood?

That's something I would need access to medical records to determine.
