uroseygirl, the two situations you cite - womans' voting and the end of slavery - were not accomplished by judicial action.

I absolutely LOVE the pictures of the breastfeeding babies. That is the sweetest thing in the whole world. I wish I could do that again, but I think my 15 yr old may balk! LOL

I have three uncles, two are gay (maternal and paternal). Both feel that same-sex marriage is absurd. Marriage is meant to be between a man and a woman.

This is exactly what ended laws prohibiting mixed race marriage. CA was the first court to declare such laws violated its constitution, in fact is was one of the precedents used when the rather conservative court (you understand incorrectly if you think our Supreme Court is liberal -- the 9th circuit is, but not the CA Supreme Court) declared that Prop 22 was unconstitutional.

Had the legislature/voters stayed out of the marriage law business entirely, I doubt we'd have legal same sex marriage anywhere in the US today. But folks decided to define marriage legally -- and those laws did not, according to the Courts in those states, mesh with the Constitutions in those states.

Personally, I don't think it's absurd although I respect the right of others to differ.
