Court OKs Voter Challengers at Ohio Polls

CINCINNATI (AP) -- A federal appeals court has cleared the way for challengers to be present at polling places in Ohio, ruling early Tuesday that their presence on Election Day is allowed under state law.


A three-judge panel of the 6th U.S. Circuit Court of Appeals ruled 2-1 to grant emergency stays of two federal judges' orders Monday that barred political parties' voter challengers in Ohio. The judges also consolidated the two cases.


The court said that while there is a strong public interest in letting registered voters vote freely, there is also "strong public interest in permitting legitimate statutory processes to operate to preclude voting by those who are not entitled to vote."


The judges also said that smooth and effective administration of the voting laws means that the rules can't be changed in the hours immediately preceding the election.



















The dissent said the citizens of Ohio have the right to vote without the "threat of suppression, intimidation or chaos sown by partisan political operatives."


Republicans wanted to put challengers in many polling places because of concerns about fraud with hundreds of thousands of newly registered voters in a state President Bush and Sen. John Kerry both say they need to win.

Yep, you are right. I can't watch to much, or I'll be drinking Mylanta for the next two weeks. What is more irratating is that people need to realize it's becasue BOTH sides are pushing this NOT just one side. I get sick of everyone saying the Dem's have hired all these lawyers etc...it's both sides doing this. And in some cases each has justication...which is sadder.

The interesting thing about Ohio is that there are so many people who are "dual" registered in Ohio and Florida. There are also several counties that are "over registered".

That's unconscionable behavior but not that surprising. And a few cameras might intimidate people? Give me a break.

but the million dollar question is whether or not *they* are going to allow those votes to count in the end. Something like that is happening here in TX too - even if you're not a registered voter on *their* list, you may be able to cast a vote but there is no guarantee that your vote would count as a popular vote or not............BTW, I grew up in Cincinnati, west side. Couldn't help but view your profile. Where are you?!

I was raised in Oakley and I have lived in East Walnut Hills for the past 15 years. I went to Withrow. What high school did you go to? What neighborhood did you live in?


So far so good here in Hamilton County! I went to vote at 3:00 pm and there were no camera crews, no long lines and no problems! I was so relieved!

My personal problem with the cameras is that I'm a victim of domestic violence and I have worked very hard to "hide" from the person who abused me and my dd. The last thing that I need is this idiot seeing me on TV going in or out of a polling place in my neighborhood. Then he would know that I am indeed back in this area!


If it weren't for that, the potential of having cameras at my polling place would not bother me at all! I'm sure there
