The United States is not liable under the Federal Tort Claims Act for injuries to members of the armed forces sustained while on active duty and not on furlough and resulting from the negligence of others in the armed forces. Pp. 136-146

I saw a story about this a while ago...so awful!!

Very tragic, and sad.... I think that if there is just cause for a lawsuit, they should be able to sue, military or not. I don't understand why there is a different set of rules on this for the military. It doesn't make sense.

The original article that tednlisa posted, although lengthy and filled with legalese, explains quite well.

she understand what it said but she doesn't understand WHY it is acceptable. If a doctor neglected his duty and your husband(God Forbid) lost his life unnecessarily would it be OK? The military should be held to the same standards has general society. I am not talking about frivolous lawsuits I talking clear cases of wrong/malpractice/illegal activity. It's a shame that we have to accept such mistreatment of our husbands. I, for one, think it's crap.

Not until we can hold society to the same standards as the military!

What in the world makes you think the military doesn't have the necessary means to effectively deal with cases of malpractice and illegal activity?

Have you not heard of the Military Justice System?

It's a voluntary military afterall--nobody is forced to join.

If you understand what the article says, then surely you understand that there IS recourse for such a case. It just isn't handled the same way as a civil claim. You make it sound like if a soldier/sailor dies from an incompetent doctor that there is absolutely no compensation, and that just isn't true.

I did start to read it, but after so much "legalese" my brain just sort of shuts down and I don't comprehend a word...

So service members are held to a higher standard BUT recieve a lower standard of treatment ?? That makes sense
