Yes, Philip Berg certainly should.
These lawsuits remind me of a story I heard a while back about shock jocks railing against Republicans who were about to sign a bipartisan immigration reform bill. Apparently, several representives were sent death threats and the reps changed their positions and withdrew their support.
While lawsuits are certainly more favorable than death threats, it seems that internet rumors and whisper campaigns can have a similar impact on a small population of individuals that will get themselves so worked into froth over a rumor and/or lie that they would go to great lengths to preserve their version of the "truth".
Just today I heard someone speculate that there could be a lawsuit filed to compel the Obama campaign to reveal the names of all small donors (less than $200). The rumors that "bad guys" were among the list of donors, I suppose, are heating up. I doubt he would have to reveal the names, but it could threaten the legions of small donors who give in small amounts and prefer to stay out of the spotlight. Republicans could regret this one if a precedent is set.
Lots of cases in this country get appealed but very few are ever heard by the Supreme Court, especially cases that are shown to have such little merit.
No judge or court has said that this case does not have merit.
Which cases has the Supreme Court heard which were dismissed for the plantiff not having standing to bring the case in the first place?
Actually, the lawsuit was dismissed as the allegations were vague and frivolous.
No judge or court has said that this case does not have merit.
>Whether or not Barack Obama is a citizen of the US isn't a Constitutional matter.<
Then what kind of matter is it?
Strange that you think a Presidential candidate's citizenship has no relationship with the Constitution.

Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."
The judge also said the harm Berg alleged did "not constitute an injury in fact" and Berg's arguments to the contrary "ventured into the unreasonable.">>>>
Good try my friend.
