Except we know that's silly because pro-choice is a term coined specifically for use when it comes to abortion. Just like pro-life was term coined specifically for use when referring to abortion.

But do you mean by "the state"? You talk about it as if it were an entity with decision making powers. The state is composed of individual decision makers. So it is individuals who decide. Just like corporations "don't pay taxes". People do. Individuals; shareholders, customers and/or employees.
Not to mention the individual who commits the "capital crime" has made the decision to risk his life and/or put it in the hands of other individuals to manage.
