Today's dispute over a Washington handgun ban is one of the most closely watched cases since then. It marks the first time the court will directly take up the scope of the Constitution's Second Amendment. The overriding question is whether it protects an individual right to bear arms or only a collective state right, for example, for National Guard units.

Sorry, that was an oversite coming from typing it rather than cutting and pasting (that and trying to get all the extraneous commas in the right place).


You have one argument, its not the only argument, even within the halls of the Supreme Court.


And, just for Point of Fact, the Bill of Rights was ratified in 1791, prior to the Militia act of 1792.
