No, that's not right. The search warrant isn't granted BECAUSE law enforcement has evidence, it's HOW they get the evidence when they have NONE. They have no evidence--only probable cause, which is basically: suspicion of illegal activity. A judge determines if the suspicion is sufficient to override the right to privacy. "I have a feeling" isn't enough; "You look like a drug dealer," from your post, isn't enough. These federal agents aren't looking for beards and burquas--they are going on associations with known terrorists and movements and activities suggestive of terrorism--just as the cops and DEA goes on associations with known drug dealers, and movements and activities suggestive of drug dealing. Probable cause IS NOT evidence--it's actually the lack of evidence, but just enough suspicion to "warrant" violating your rights. That's why a "warrant" is called that--it is a judge saying, "This situation as I see it warrants that the police violate your rights and look for evidence of criminal activity.

They don't have the right to eavesdrop without a warrant, or search. They need a FISA warrant to wiretap or search. However, they can, under the Patriot Act, in the program run by the NSA, document the number called and the date and time. The conversation isn't recorded, only the number, date and time. That's not the same as wiretapping--wiretapping, in order to violate a right to privacy, must involve the recording of the conversation. That's not NSA's purpose, and that's not what their records show.

As for probable cause, that's written all over the patriot act: "suspected terrorist activity" is, IMO, probable cause.

I think the the congresspeople got more calls from the "no" side because most people expected the bill would pass.
