SAN FRANCISCO — A retired Presbyterian minister was found guilty of misconduct Friday by a church court for officiating the weddings of 16 gay couples when same-sex marriage was legal in California.

A regional commission of the Presbyterian Church (USA) ruled 4-2 that the Rev. Jane Spahr of San Francisco "persisted in a pattern or practice of disobedience" by performing the weddings in 2008 before Proposition 8 banned the unions in the state.

The church's highest court has held that Presbyterian ministers may bless same-sex unions as long as they do "not state, imply, or represent that a same-sex ceremony is a marriage."

By willfully challenging that holding, Spahr broke her ordination vows, the commission said in its majority opinion.

At the same time, however, the tribunal devoted most of its 2 1/2-page ruling to praising the 68-year-old pastor, a lesbian who founded a church group in the early 1990s for gay Presbyterians.

Spahr was acknowledged "for her prophetic ministry" and "faithful compassion. The commissioners called on the broader church to use her example "to re-examine our own fear and ignorance."

"In the reality in which we live today, marriage can be between same gender as well as opposite gender persons, and we, as a church, need to be able to respond to this reality as Dr. Jane Spahr has done with faithfulness and compassion," the ruling stated.

The six-member commission representing 54 Northern California churches censured Spahr with a rebuke as punishment. Spahr said she was disappointed by the verdict and would appeal to a midlevel church court."

In a church court. Which has no secular legal repercussions at all.

And yet people are so frightened of the possibility of Sharia courts.

But more to the point - I hope she does appeal, and I hope that "re-examining" happens, too.

Yes, it's "only" a church law and not one of our secular laws. However, people who believe this, vote. Churches throw money into campaigns to pass laws denying civil rights. Like the Prop. 8 travesty. Laws being past limiting access to abortion are ways to make the legality of it moot if a woman cannot find access if that is her choice. Depending on where she lives, heck, she might not find a pharmacy to fill BC Rx's, either. Or the morning after pill. Etc. Same with denying access by pharmacists using their beliefs as an excuse to subvert legal access and laws. Or locally sanctioning or looking the other way when access to housing or jobs is denied. Or children harassed or vandalism occurs because beliefs or something else is "different.". Not secular law or theocracy of the Inquisition or the Sharia version of theocracy, yet still infecting and denying and controlling. While we don't have a violent and cruel theocracy, religion still strives to control and dominate in this country. Sharia law is theocracy and at times just as violent and intolerant as the Inquisition was. Religion in bed with gov't. A very scary combo when it comes to civil rights or human rights. And some religious focused group seek to create a theocracy here, working through politics and manipulating laws or ignoring some in an effort to reform our secular gov't into a theocracy. Teachers in public schools pushing religion on their students. Pushing for school led prayer, of only one religion. Pushing religion into a science curriculum. So fearing a theocracy being created, even if not in name, but by subverting or not enforcing laws, is very real. Attempts being made all the time. And not always challenged. :O

I hope she can be an agent of change for the good, too. And she is very courageous to do so. Change needs to come from within, and people with the vision of a more loving and open understanding can make that difference. It's not easy to learn to live in diversity with peace and mutual respect. Without a desire to control and make everyone be the same, or just shut up and be silent. :O

The irony is that there are people who want this country to be a decidedly Christian nation with laws based upon. Yet they don't see that what they want is no different than a country with Sharia law.
