(AP) – 1 day ago

CONCORD, N.H. — A New Hampshire sex offender is asking the state's highest court to allow him to go to church with a chaperone.

The case of 35-year-old Jonathan Perfetto of Manchester marks the first time the New Hampshire Supreme Court is being asked to rule on whether a probation condition that effectively bars church attendance violates a person's constitutional rights to religious freedom.

Perfetto was convicted in 2002 of possessing child pornography. A condition of his probation is that he have no contact with children. A lower court denied Perfetto's request to attend Jehovah's Witnesses services with a church elder acting as a chaperone.

The New Hampshire Civil Liberties Union and Perfetto maintain the chaperone would eliminate any risk to children. The state says public safety trumps Perfetto's religious rights."

I agree. Other people's safety and their own right to their own religious freedom, and that of their children, trump an individual's right to practice, given the potential harm possible in this case. :// IMO, religious freedom *stops* when it interferes with another's practice of the same freedom. IMO, no one can exercise *any* freedom in a vacuum. Not when we must all live together in some kind of mutual respect in communities, and yes, safety, as well. There is no "religious freeedom" to commit honor killings, for example. Or force minors into marriages and pregnancy. Or any other behavior that would in the exercise thereof, cause harm, or potential or likely harm, to another person.

This is SO IMPORTANT and something that needs to be understood by a lot of people!!! I wish we could all find a phrasing that got through to the "freedom OF religion not freedom FROM religion" people!!! (Which is just a ridiculous phrase, if you do not have freedom FROM religion, it is impossible to have freedom OF religion!)

I agree. There is a sometimes a nearly complete mental disconnect that one's personal freedoms must stop before limiting or harming another person's freedom to practice his/her religion. I think this situation is a "no-brainer" to protect children. :// It occurred to me that the person could meet privately with the religious leader for worship or religious study or what have you, thus not exposing other parishioners. The location, when & where, of course, to be when there are no children on church property, and the person is never left alone while there meeting with the church leader. With a little "creative problem solving" a solution could be found, I would think, that met the conditions of his probation and protected the children of the congregation at the same time.

I have to say that I am not sure he should not be allowed to go to church. He was convicted of possessing child pornography. Did he take the photos himself? Had he acted out in any other ways toward children? If the answer to either of these questions is yes, then NO, he shouldn't be allowed, but if the answers to both were no....hm....

Evidently it's a condition of his probation, so I guess the court case is about changing the conditions of his probation as regards his church attendance. I didn't know that probation conditions were debatable/changeable, but apparently they are trying to make it so with this lawsuit. Guess we'll have to see what happens in the upcoming court case, if they judgment changes the lower court's original ruling denying the use of a chaperone as sufficient. Since the article says he was charged "only" with *possession* of child pornography, maybe they think they have a case, if he didn't actually take photos/videos himself or lure a child to take photos/videos. Not enough information in the article...
