I think in this story, it does have to do with licensing; it's illegal to operate a daycare (home or center) without a license in Virginia. The kids got locked up because the provider was trying to hide the daycare's existence.
If she'd been licensed, she wouldn't have needed to hide the kids.
My reaction is pretty much the same as when stories like was was in last night paper here about a couple that were arrested when their 1 year old, 2 year old and 3 year old were tested postitive for meth (the same kind of stories that are in the news every day in this country).
