What teacher has declined to speak with parents? Setting availability times is not declining to speak with someone. It seems to me that this thread has been about whether parents should be able to speak directly to a teacher at any time without regard for whether or not the teacher is on duty or off duty.
I'll try for further clarification although I fear that you are making this more difficult than it really is (or even needs to be).
