Where was that stated or applied in this thread? We've discussed "debated" hands-on, day-to-day help of grade 3 and above homework. The hands-off homework parents, including myself, are quite involved with our children's education and school system. Did I miss a something?
I think that prior to NCLB, many US public schools definately WERE letting kids fail because they didn't see it as their problem/responsibility if kids failed. It was the kid's problem. NCLB made it the school's problem, which is its only benefit so far that I can see. When I was young, it did not trouble the school at all that I made D's in algebra. It wasn't their problem that I didn't understand it. It was considered my problem. This isn't unique to me since two other posters also brought up failing grades in algebra that warrented no intervention from the school. And of course it isn't unique to algebra.

I don't think it's that the schools are letting kids fail because they don't feel it's their responsiblity.
Oops--not true.
