There was an article in this month's Working mother magazine about wrking mom's losing custody to SAHD's.

This is a rather extreme case. Would the Judge make the same decision if the situation were reversed? Probably, so it isn't a gender issue.

The same thing might happen if the case were reversed. But if the case were between a SAHM and a working dad, I doubt the lawyer would have argued that the SAHM was just too lazy to get a job.

This happens to men all the time.

My thoughts exactly.

Although the bit about her business affecting her ability to be a nurturing mother peed me off a bit. Nobody EVER says a man is less of a dad if he works.

What I don't get is why joint physical custody is not the default option unless there are some seriously dramatic issues with one parent or the other. In Sweden, it is the default option. A parent has to be proven massively incompetent to lose the right to joint physical custody (which mostly entails the kids spending 50% of their time with each parent).

I agree that's what should have happened here-- at least with the information provided.

But why?

I agree. I also strongly disagree that mothers are automatically the better parent or should by default be given custody when there is an involved and capable father.
