Once a person is released because of an impending new trial, that person is no longer convicted.

"A new trial is a reexamination of the issue in the same court, before another jury, after a verdict has been given. The granting of a new trial places the parties in the same position as if no trial had been had." Not ok to take a human life with regards to the death penalty.

But ok to take a life to defend your home.

THAT IS WHAT I HAVE SAID ALL ALONG. I have said that if a criminal is given a new trial on a technicality WHILE IN PRISON he/she is released pending a new trial. I was told that was wrong. The case I posted proves that and so does your post.

Not the same scenario, so a double standard can't be applied. And yet again, NO ONE on the opposite of you in this debate has said it is OK to take a life to defend one's home.
