Who's last name does the baby get if you're not married?

  • Mom's last name
  • Dad's last name

I agree with the previous post, who ever has custody. If you are raising the child together, then the fathers name. Just my opinion :)

I guess it depends on whether or not the dad is in the child's life and/or on the birth certificate. If he is, then the child should get his last name. If not, then the mom's last name. It becomes problematic if there are multiple children with multiple fathers--all these different last names in the same household! It is hard enough with two different last names (I kept my maiden name when I married, kids have dad's last name)

I voted for Dad's last name, but really it could be mom's, dad's or both even! If you plan on getting married and you are taking dad's last name I would say use dad's for baby.

I think it depends on state law. In some states if dad is listed on the birth certificate, the baby gets his last name (unless he agrees to hyphenate or use mom's). If dad isn't listed on the b.c., and you go back later to try and get child support, most states will change the child's last name then. Of course dad can always say he doesn't care what the child's last name is and then you can do what you want. HTH

My son has my name b/c his father and I weren't together when he was born. He decided long before Konner was born that he didn't want anything to do with him so he got my name. But my friend had 3 kids with the same man before they were married and all 3 of those kids got his name because they were together and she knew that he would be in their lives forever.

I'm trying to figure that out myself. I have been with the father of my baby for 2 years, I do not want to marry him...ever. I don't want to hurt his male ego by giving the baby my last name but on the other hand my brother is the last hope to carry on my last name and he only has a girl, I am having a boy and my last name is something i am very proud of. I'm going to keep checking on these results. The father gets super pissed at the mere mention of my last name.
